Welcome to Store Cards – Wallet Pass. By accessing or using our mobile application ("App") and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use our services.

1. About Store Cards – Wallet Pass Services

Store Cards – Wallet Pass provides a mobile application for managing loyalty cards, including:

  • Storing and organizing loyalty card information.
  • Scanning and recognizing barcodes and card data.
  • AI-powered brand recognition and card customization.
  • Exporting cards to Apple Wallet.
  • Syncing card data across your devices via iCloud.

Some features may require account creation or a paid subscription.

2. Eligibility and Account Creation

  • You must be at least 13 years old to use Store Cards – Wallet Pass.
  • If you are between 13 and 18 years old, you must have parental or guardian consent.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.

3. Use of Store Cards – Wallet Pass Services

We grant you a limited, non-exclusive, non-transferable license to use Store Cards – Wallet Pass for personal, non-commercial purposes on iOS devices you own or control.

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to any part of the App or its systems.
  • Use automated tools, bots, or scripts to access the App without our permission.
  • Reverse engineer, decompile, or disassemble the App.
  • Upload content that is illegal, harmful, or infringes on others' rights.
  • Interfere with or disrupt the App's functionality or servers.

4. User Content

You retain ownership of the content you create or upload to Store Cards – Wallet Pass (card data, images, etc.). By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your content solely for the purpose of providing and improving our services.

You represent and warrant that:

  • You own or have the right to use the content you upload.
  • Your content does not violate any third party's intellectual property or privacy rights.
  • Your content complies with all applicable laws.

5. Subscriptions and Payments

Store Cards – Wallet Pass offers subscription plans with additional features:

  • Lite: Unlimited cards and iCloud sync.
  • Pro: All Lite features plus AI-powered card creation.

Subscription terms:

  • Subscriptions are billed through the Apple App Store.
  • We use Adapty, a third-party subscription management platform, to validate purchases, manage subscription status, and support subscription analytics.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in your App Store account settings.
  • Refunds are handled according to Apple's refund policies.

6. Intellectual Property

Store Cards – Wallet Pass and its contents, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App or its content without our permission.
  • Use our trademarks, logos, or branding without written consent.
  • Remove any copyright or proprietary notices from the App.

7. Third-Party Services

Store Cards – Wallet Pass integrates with third-party services including:

  • Apple Wallet for pass generation.
  • iCloud for data synchronization.
  • Adapty for subscription management and purchase validation.
  • AI services for brand recognition.

We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.

8. Termination

We may suspend or terminate your access to Store Cards – Wallet Pass at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the App will immediately cease.
  • Provisions regarding intellectual property, disclaimers, limitation of liability, and indemnification will survive.

You may delete your account at any time through the App settings.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, error-free, or secure.
  • Any errors will be corrected.
  • The App will meet your specific requirements.
  • Barcodes generated by the App will be scannable at all retail locations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content.
  • Inability to use loyalty cards at retail locations.
  • Unauthorized access to your account.
  • Any other matter related to the App.

Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Store Cards – Wallet Pass and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms.
  • Your use of the App.
  • Your content uploaded to the App.
  • Your violation of any third party's rights.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on our website.
  • Updating the "Last Updated" date.
  • Notifying you through the App for significant changes.

Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. App Store Additional Terms

If you downloaded Store Cards – Wallet Pass from the Apple App Store:

  • Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • Apple is not responsible for addressing any claims related to the App.
  • Apple is a third-party beneficiary of these Terms.

15. Miscellaneous

  • These Terms constitute the entire agreement between you and Store Cards – Wallet Pass.
  • If any provision is found unenforceable, the remaining provisions remain in effect.
  • Our failure to enforce any right does not waive that right.
  • We may assign these Terms; you may not assign them without our consent.
